1. Agreement to Terms

By accessing or placing an order through the Indigenous Coffee Culture ("ICC") online store, you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, customers, and others who access or use our store. If you do not agree with any part of these Terms, you may not access or use our store.

ICC is operated by Tekina Consulting Solutions LLC. References to "ICC," "we," "us," or "our" in these Terms refer to Indigenous Coffee Culture and its parent company, Tekina Consulting Solutions LLC.

2. Our Products & Roasting Process

ICC is a specialty coffee brand committed to cultural reclamation, heritage, and community-centered enterprise. We take pride in delivering the freshest roasted coffee directly to your doorstep, anywhere in the world. 

Fresh-to-Order Roasting Promise:

• We do not roast your coffee until your order is received.
• Every order is roasted and shipped within 72 hours of purchase.
• This process ensures you receive the freshest possible roasted coffee beans.
• Roasting and shipping timelines may be affected by holidays, high order volume, or events beyond our control. We will notify you of any delays.

 

By ordering from ICC, you acknowledge that our made-to-order model means orders cannot be cancelled once the roasting process has begun.

3. Orders & Payment

3.1 Order Acceptance

Placing an order constitutes an offer to purchase. ICC reserves the right to accept, decline, or cancel any order at our discretion. You will receive an order confirmation email once your order is accepted.

3.2 Pricing

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. ICC reserves the right to modify or discontinue products at any time. We are not responsible for typographical errors in pricing.

3.3 Payment

Payment is due in full at the time of purchase. We accept major credit cards, debit cards, and other payment methods as listed at checkout. By submitting payment, you represent that you are authorized to use the payment method provided.

3.4 Taxes

Applicable sales taxes will be calculated and added at checkout based on your shipping address and local tax laws.

4. Shipping & Delivery

ICC ships freshly roasted coffee to customers around the world. We are proud to bring the goodness of freshly roasted coffee beans directly to your doorstep, wherever you are.

• Orders are roasted and shipped within 72 hours of purchase.
• Shipping rates and estimated delivery times are calculated at checkout based on your location.
• International orders may be subject to customs duties, taxes, or import fees, which are the sole responsibility of the customer.
• ICC is not responsible for delays caused by carriers, customs processing, or events outside of our control.
• Risk of loss and title for products pass to you upon our delivery of the order to the carrier.

 

If your order is lost or significantly delayed in transit, please contact us at the information provided below and we will work to resolve the matter promptly. 

5. Returns & Refunds

Due to the perishable and made-to-order nature of our roasted coffee products, all sales are final. We do not accept returns on roasted coffee.

However, if you receive a product that is:

• Damaged or defective upon arrival,
• Incorrect (wrong product or origin shipped),
• Significantly different from what was described,

 

please contact us within 7 days of delivery. We will review your claim and, at our discretion, offer a replacement, store credit, or refund. Photographic evidence of the issue may be required.

6. International Orders

ICC is proud to ship to customers around the world. For international orders, please be aware of the following:

• You are responsible for ensuring that the products ordered are lawful to import in your country.
• Customs duties, import taxes, and brokerage fees are the responsibility of the customer and are not included in the purchase price or shipping cost.
• ICC cannot be held liable if customs authorities seize or delay your shipment.
• Delivery timelines for international orders are estimates only and may vary significantly.

 

7. Intellectual Property

All content on the ICC online store — including but not limited to the ICC name, logo, GUATIAO Ally Symbol, Taino cultural imagery, product descriptions, photography, and brand materials — is the exclusive property of Indigenous Coffee Culture and Tekina Consulting Solutions LLC, and is protected by applicable intellectual property laws.

 You may not reproduce, distribute, modify, or create derivative works of any ICC content without our prior written consent. Unauthorized use of ICC's cultural symbols, brand identity, or intellectual property is strictly prohibited and may constitute a violation of applicable law.

8. User Conduct

By using our store, you agree not to:

• Use the store for any unlawful purpose or in violation of any applicable law or regulation.
• Submit false or fraudulent orders or payment information.
• Attempt to gain unauthorized access to any portion of the store or its systems.
• Engage in any conduct that restricts or inhibits any other user from using or enjoying the store.
• Use automated systems (bots, scrapers, etc.) to access or interact with the store without our express permission.

 

9. Disclaimers

THE ICC ONLINE STORE AND ALL PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ICC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ICC does not warrant that the store will be uninterrupted, error-free, or free of viruses or other harmful components. 

10. Limitation of Liability

To the maximum extent permitted by applicable law, Tekina Consulting Solutions LLC and Indigenous Coffee Culture shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the store or purchase of our products, even if advised of the possibility of such damages. 

Our total liability to you for any claim arising from these Terms or your use of the store shall not exceed the total amount you paid for the order giving rise to the claim. 

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the applicable laws of the state in which Tekina Consulting Solutions LLC is registered, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the ICC store shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable rules before resort to litigation.

12. Changes to These Terms

ICC reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the store. Your continued use of the store following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
